What does not require a building permit but does require notification?

Pursuant to Article 29.3 (Construction Law Act), a building permit decision is not required, but the performance of construction works consisting in:

  1. Reconstruction:
        a) external partitions and structural elements of single-family residential buildings, unless it leads to an increase in the impact area of ​​the facility beyond the plot on which the building is located,
        b) facilities referred to in section 1 points 2, 3, 9, 11–13 and 30,
        c) gas networks and electricity networks other than those mentioned in section 1 point 2 letter a and e,
        d) roads, tracks and railway equipment,
        e) consisting in insulating buildings with a height above 12 m and not higher than 25 m,
        f) installations of renewable energy sources with a total installed electrical capacity of not more than 1 MW using hydro energy to generate electricity within the meaning of the Act of February 20, 2015 on renewable energy sources (Journal of Laws of 2020, item 261, 284, 568, 695 and 1086);
  2. Renovation:
        a) structures whose construction requires obtaining a building permit,
        b) buildings whose construction requires obtaining a building permit - regarding external partitions or structural elements;
  3. Installing:
        a) on building structures constituting or not constituting the entire technical and operational devices, including antenna support structures and radiocommunication installations, as well as accessories and power supply devices related to these devices, with a height exceeding 3 m,
        b) grates on multi-family residential buildings, public buildings and collective residences,
        c) advertising boards and devices, with the exception of illuminated and illuminated advertisements located outside built-up areas within the meaning of road traffic regulations,
        d) gas installations inside and outside the building used,
        e) agricultural biogas micro-installation referred to in Art. 19 section 1 of the Act of February 20, 2015 on renewable energy sources.

Which does not require a building permit or notification

  1. Reconstruction:
        a) buildings whose construction requires obtaining a building permit and single-family residential buildings, excluding the reconstruction of external partitions and structural elements,
        b) facilities referred to in section 1 points 4-8, 10 and 14-29 and in section 2,
        c) consisting in insulating buildings with a height not exceeding 12 m,
        d) construction equipment;
  2. Renovation:
        a) buildings, excluding renovation: - buildings whose construction requires a building permit, - buildings whose construction requires a building permit - in the field of external partitions or structural elements,
        b) construction equipment;
  3. Installing:
        a) on building structures constituting or not constituting the entire technical and operational devices, including antenna support structures and radiocommunication installations, as well as accessories and power supply devices related to these devices, with a height not exceeding 3 m,
        b) grates on buildings, excluding the installation of grates on multi-family residential buildings, public buildings and collective residences,
        c) heat pumps, free-standing solar collectors, photovoltaic devices with an installed electrical power of not more than 50 kW, provided that photovoltaic devices with an installed electrical power of more than 6.5 kW are subject to the obligation to agree with a fire protection expert in terms of compliance with fire protection requirements, hereinafter referred to as "fire protection agreement", the design of these devices and the notification of the State Fire Service authorities referred to in Art. 56 section 1a,
        d) installations inside and outside the building in use, excluding gas installations;
  4. Hardening of the ground surface on building plots.
