What can be built without permission and without notification?

Pursuant to Article 29.2 (Construction Law Act), a building permit decision and notification are not required for the construction of:

  1. Farm buildings related to agricultural production and supplementing the farm development within the existing plot of land:
        a) single-story farm buildings with a building area of ​​up to 35 m², with a structure span of no more than 4.80 m, b) container drying rooms with a building area of ​​up to 21 m²;
  2. Sheds with a building area of ​​up to 50 m², located on a plot on which there is a residential building or intended for residential construction, and the total number of these sheds on the plot cannot exceed two for every 1,000 m² of the plot area;
  3. Free-standing gazebos with a building area of ​​up to 35 m², with the total number of these facilities on the plot not exceeding two for every 500 m² of the plot area;
  4. Allotment gazebos and farm facilities referred to in the Act of December 13, 2013 on family allotment gardens;
  5. Bus and platform shelters;
  6. Single-story buildings with a building area of ​​up to 35 m², used as facilities for the ongoing maintenance of railway lines, located on land owned by the State Treasury, with the exception of buildings located in the Natura 2000 area;
  7. Parking spaces for passenger cars up to 10 spaces, except for those located in a Natura 2000 area;
  8. Commercial buildings with a built-up area of ​​up to 35 m², with a structure span not exceeding 4.80 m, and ponds and water reservoirs with an area not exceeding 500 m² and a depth not exceeding 2 m from the natural surface of the land, intended exclusively for forest management purposes and located on land forests of the State Treasury, except for those located in the Natura 2000 area;
  9. Free-standing telephone booths, cabinets and telecommunications poles;
  10. Self-powered parking meters;
  11. Exits from district and municipal roads and parking bays on these roads;
  12. Culverts with internal cross-section up to 0.85 m²;
  13. Home swimming pools and ponds with an area of ​​up to 50 m²;
  14. Building structures that are water drainage devices;
  15. Coastal strips and other artificial, surface or linear strengthening of the banks of rivers and mountain streams, as well as the sea shore, the shore of internal sea waters, not constituting retaining structures;
  16. Ramps intended for disabled people;
  17. Telecommunications cable lines;
  18. Measuring devices, including fences and internal roads, of the state hydrological and meteorological service and the state hydrogeological service:
        a) water gauge, meteorological, rainfall and groundwater stations,
        b) points: observation of groundwater levels and monitoring of groundwater quality,
        c) observation piezometers and enclosed sources;
  19. Small architectural objects, except small architectural objects in public places;
  20. Fences with a height not exceeding 2.20 m;
  21. Facilities intended for temporary use during construction works, located on the construction site, and setting up barracks trucks used in construction works, geological research and geodetic measurements;
  22. Temporary building structures constituting only exhibition exhibits, not performing any utility functions, located in areas designated for this purpose;
  23. Geodetic signs, as well as triangulation objects, outside the area of ​​national parks and nature reserves;
  24. Military training ground structures, in particular defensive positions, crossings, earthen structures, fortification structures, temporary installations and container facilities, located in closed areas designated by the Minister of National Defense for conducting military exercises using field camps and area fortifications to simulate direct combat;
  25. Housing of groundwater intakes;
  26. Charging points, within the meaning of Art. 2 point 17 of the Act of 11 January 2018 on electromobility and alternative fuels, excluding road public transport charging infrastructure;
  27. Devices located in the right-of-way of public roads, along with foundations, supporting structures and associated equipment elements:
        a) used for road management, including the implementation of intelligent transport systems,
        b) used for road traffic management, including road traffic safety devices,
        c) referred to in Art. 13o section 1 and art. 20g paragraph 1 of the Act of March 21, 1985 on public roads;
  28. ATMs, ticket machines, cash deposit machines, vending machines, parcel storage machines or machines used to provide other types of services up to and including a height of 3 m;
  29. Container facilities with installations, connections and related networks:
        a) electricity,
        b) water supply,
        c) sanitary sewage system,
        d) thermal – located in closed areas designated by the decision of the Minister of National Defense;
  30. Above-ground tanks that are buildings, used to store class III liquid fuels, for the user's own needs, with a capacity of up to 5 m³;
  31. Above-ground home terraces with a building area of ​​up to 35 m²;
  32. Ponds and water reservoirs with an area not exceeding 1,000 m² and a depth not exceeding 3 m, located entirely on agricultural land.
